Who we are
Frank Plans is a trading name of Empire Concepts Pty Ltd (ABN 35 110 696 574). We follow the Australian Privacy Principles in the Privacy Act 1988. Contact us about privacy at frank@reply.frankplans.com.au.
What we collect
- Contact details: your name and email address.
- Your Frank Check answers: who the plan is for, your situation, your state and region, and anything you choose to type.
- Your intake answers and documents: the follow up answers and any optional documents you upload, such as sales or cost reports.
- Payment details: handled by Stripe. We never see or store your card number. Stripe gives us a scrambled card identifier (a "fingerprint") and the last four digits, which we use only to make sure the $29 first month and referral offers are used once per card.
- Referrals: if you join through someone's link, we record who referred you so we can give them their reward. We don't tell them anything about you or your plan beyond the fact that you joined.
- Your Frank File (members): a short record Frank keeps so he can build on what he already knows: your goals, ideas from your plans, key numbers from your plans or that you choose to tell Frank, decisions, results, how you like Frank to talk to you, and what you'd like in your Monday email. It's made from your plans, what you choose to add in your portal, your emails to Frank and, if you switch on "Remember useful things from our chats", short notes from your chats with Frank. It is never made from your chats with Frank. It never holds your documents, and Frank is told not to record health details, ID or account numbers, or other sensitive information.
- Chat with Frank (members): Frank doesn't keep your chats. The conversation itself is never saved by Frank in our database, storage, logs or analytics, and it's gone when you leave the page. If you switch on "Remember useful things from our chats" (it starts off), Frank adds short notes of lasting things you tell him, like a goal, a decision or a number from your business, to your Frank File, so your next plan and Monday email build on them. Health details, ID, card and bank numbers and other sensitive details are never saved from a chat. You can see and delete each note in your portal, or switch it off above the chat at any time. Switching it off stops new notes; Frank still uses what's already in your Frank File, which you can delete. To write each reply, your words are sent to our AI providers, which may hold them for a limited time for safety checks under their business terms, and never use them to train their models. We keep only the cost of your chats each month (a number), to run your chat allowance. A Word document or spreadsheet Frank makes for you in a chat is handed straight to your device and not kept by Frank.
- Emails you send us: messages to frank@reply.frankplans.com.au are read and answered by Frank's automated assistant first.
- Technical information: basic logs needed to run and secure the service, and a one way scrambled version of your internet address to stop abuse.
We ask you not to upload identity documents, card or bank account numbers, tax file numbers or health information. We don't need them. If you don't give us the information we ask for, your plan may be less specific.
Why we collect it
To write your outline and your plan, run your account and membership, send you service emails (receipts, plan ready, renewal reminders), keep the service secure, and meet our legal obligations. We only send marketing emails if you say yes, and every one has an unsubscribe link.
How your plan is made, and who sees your information
Frank's team of AI specialists reads your answers and documents and writes your plan. The system then checks it automatically. No person reads your information to make your plan. Someone at Frank Plans would only look at it if you ask us to (for example to fix a problem with your plan), to fix a technical fault, or if the law requires it. Every time the system opens one of your documents it is logged.
We use these service providers to run Frank:
- Our AI providers (two, both in the United States) provide the AI models that Frank's team of agents runs on. We use two so your plan is never held up if one is unavailable, and so one can double check the other's work. Only the information needed for your plan is sent. Under their business terms your information is not used to train their models, and we never opt in to sharing it. Each keeps data for a limited period (up to 30 days) for safety and abuse monitoring only.
- Supabase stores your account, answers and documents in its Sydney, Australia data centre, encrypted in transit and at rest.
- Stripe processes payments.
- Resend (United States) sends our emails.
- Netlify (United States) hosts our website and runs the software that builds plans.
This means your information is processed in the United States as well as Australia. We choose providers with strong security and contracts that protect your information. We never sell your information or share it with anyone for their own marketing.
Stored in Australia, processed in the US: what that means
On our website we say your information is "stored in Australia, processed securely in the US to build your plan". In plain English:
- Stored: your account, your answers, your documents and your plans are kept in Supabase's Sydney data centre. That is where your information lives.
- Processed: to build a plan, or to write a reply in Chat with Frank, the parts needed are sent securely to our AI providers and to Netlify's systems in the United States. They are used there to do that job, not kept there as your records. The AI providers may hold them for a limited period (up to 30 days) for safety and abuse monitoring only, and never use them to train their models.
- Emails: the emails we send you, like your plan and your Monday email, go out through Resend in the United States.
When we send your information overseas we take reasonable steps to make sure these providers protect it, through their security and their contracts with us. If you'd rather not have your information processed outside Australia, please don't upload documents or start a plan, and contact us through your portal to close your account.
Decisions made by computer
Computer programs use your information to write your plan, to decide whether a plan passes our checks, whether to ask you one follow up question, and whether a plan that can't pass should be refunded. They also work out how much plan space a plan needs and how much you have left, whether your card can have the $29 first month or a referral offer, and whether a referral reward is due. These are decisions made by software, not a person. You can ask us about any of them at the address above.
How long we keep it
- Card fingerprints: kept for as long as needed to apply offers fairly, and deleted with your account.
- Uploaded documents: deleted automatically 7 days after your plan is delivered, or straight away when you press Delete my documents now in your portal. We keep them for those 7 days only so Frank can fix or rebuild your plan if you ask. Documents for a plan that's never finished are deleted after 60 days.
- Your plans and answers: kept in your portal until you delete your account.
- Your Frank File: kept while you're with Frank, so he can keep building on it. Delete any line of it, or the whole file, in your portal at any time. It's deleted with your account.
- Payment records: kept by Stripe and us for as long as tax law requires.
- Access logs: kept to show how your documents were handled.
Keeping it safe
Information is encrypted in transit and at rest. Documents sit in a private storage area that only the plan building software can open. Access is logged. If a data breach is likely to cause you serious harm, we'll tell you and the Office of the Australian Information Commissioner.
Your choices
- See, download or correct your information by emailing us.
- Remove an uploaded document from your portal before your plan is built.
- See, fix or delete your Frank File in your portal, under What Frank knows about you.
- Delete your account and everything in it from your portal at any time.
Complaints
Email frank@reply.frankplans.com.au and we'll reply within 30 days. If you're not satisfied, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.
